This contractual document will govern the contracting of accommodation reservations through the website https://nestanza.com/, owned by EUROCRODA S.L, under the trademark of NESTANZA, hereinafter, PROVIDER, whose contact details are also included in the Legal Notice of this Website.

These Conditions will remain published on the website at the disposal of the USER to reproduce them and save them as confirmation of the contract, and may be modified at any time by the PROVIDER. It is the responsibility of the USER to read them periodically, since those that are in force at the time of placing orders will be applicable.

Contracts shall not be subject to any formality except for the cases expressly indicated in the Civil and Commercial Codes and in this or other special laws.

Acceptance of this document means that the USER:

IDENTITY OF CONTRACTING PARTIES

OBJECT OF THE CONTRACT

This contract is intended to regulate the contractual relationship between NESTANZA and the USER at the time it accepts, during the online contracting process, the rental of properties or rooms for temporary accommodation.

The contractual relationship of booking accommodation entails the rental of the property or room chosen, for a limited time, in exchange for a certain price and publicly exposed through the website. The extra services must be contracted at the time of booking.

CONTRACTING PROCEDURE

The USER, in order to access the services or products offered by NESTANZA, must be of legal age and register through the website by creating a user account. Therefore, the USER must freely and voluntarily provide the personal data that will be required, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR), and Organic Law 3/2018 of December 5 (LOPDGDD), detailed in the Legal Notice and Privacy Policy of this website.

The USER will select a username and password, committing to make diligent use of them and not to make them available to third parties, as well as to inform NESTANZA of the loss or theft of the same or possible access by an unauthorized third party, so that it proceeds to the immediate blocking.

Once the user account has been created, it is reported that NESTANZA will act in accordance with what is required by article 27 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE).

GENERAL CONTRACTING CLAUSES

Unless particular written, the realization of a NESTANZA reservation will imply the acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of NESTANZA if it has not been expressly accepted in advance and in writing by the NESTANZA.

RESERVATION ACTIVATION AND PAYMENT

NESTANZA will inform the USER in advance about the procedure that must be followed to make the reservation of the property.

The automatic system of calculation of availability and prices allows the USER to choose the apartment or house or room that interests him and immediately make the online payment of the 1 month of deposit of the rental price as a reservation, or failing that he can make a bank transfer within a maximum of 48 hours for European residents and a maximum of 7 days for people residing outside the European Union.

NESTANZA will not book the accommodation until you have verified that the payment has been made. Once the payment is checked, NESTANZA will contact you by email to confirm the reservation. This term is understood whenever availability has been confirmed.

DEPOSIT

NESTANZA tiene un tipo de fianza consta de 2 meses completos del alquiler. El primer mes se utiliza como reserva y el segundo mes debe ser abonado a la llegada del inquilino al alojamiento por tarjeta de crédito o transferencia bancaria.

A la salida del alojamiento, previa inspección del mismo, se devolverá por transferencia bancaria en el plazo máximo de un mes.

En el caso de que haya desperfectos en el alojamiento, impagos, retrasos o cualquier incumplimiento de las normas de convivencia, se deducirán de dicha fianza.

LACK OF EXECUTION OF THE CONTRACT AT A DISTANCE

CANCELACIONES (DERECHO DE DESISTIMIENTO)

The USER has the same rights and deadlines to proceed to make the cancellation and / or claim the possible vices or defects that the reservation presents, both in online and offline mode.

Any cancellation must be communicated to NESTANZA, requesting it by email to info@nestanza.com indicating the corresponding reservation number. In case of refund of the amount, the USER could be penalized for the following concepts:

• If the reservation is cancelled between 3 months and 1 month prior to the arrival date, NESTANZA will return the customer 50% of their reservation.
• If the reservation is cancelled after 30 days prior to the arrival date, the total amount of the reservation (100%) will not be refunded.

ONLINE CLAIMS AND DISPUTE RESOLUTION

Si durante el periodo de alquiler se produjese alguna avería en las instalaciones o aparatos eléctricos, el USUARIO deberá avisar de inmediato a NESTANZA para resolver lo antes posible estas incidencias.

En caso de fuerza mayor (daños causados por agua, incendio, etc.), NESTANZA sustituirá el alojamiento reservado por otro de las mismas características. En el caso de no tener disponibilidad de alojamientos, NESTANZA le reembolsará el total del importe entregado.

RESOLUCIÓN DE LITIGIOS EN LÍNEA (ONLINE DISPUTE RESOLUTION)

Conforme al Art. 14.1 del Reglamento (UE) 524/2013, la Comisión Europea facilita una plataforma de acceso gratuito para la resolución de conflictos online entre el USUARIO y NESTANZA, sin necesidad de recurrir a los tribunales de justicia, mediante la intervención de un tercero, llamado Organismo de resolución de litigios, que actúa de intermediario entre ambos. Este organismo es neutral y dialogará con ambas partes para lograr un acuerdo, pudiendo finalmente sugerir y/o imponer una solución al conflicto.

1.  FUERZA MAYOR

Las partes no incurrirán en responsabilidad ante cualquier falta debida a causa mayor. El cumplimiento de la obligación se demorará hasta el cese del caso de fuerza mayor.

2.  COMPETENCIA

El USUARIO no podrá ceder, transferir ni transmitir los derechos, responsabilidades y obligaciones contratadas.

Si alguna estipulación de estas condiciones fuera considerada nula o de imposible cumplimiento, la validez, legalidad y cumplimiento del resto no se verán afectados de ninguna manera, ni sufrirán modificación de ningún modo.

El USUARIO declara haber leído, conocer y aceptar las presentes Condiciones Generales en toda su extensión.

3.  GENERALIDADES DE LA OFERTA

Los detalles de cada reserva, como el alojamiento y régimen alimenticio, se informan al USUARIO en su respectiva descripción en la página web.

Dados los continuos avances técnicos y mejoras de los productos, NESTANZA se reserva la facultad de modificar sus especificaciones respecto de la información facilitada en su publicidad, hasta que no afecte el valor de los servicios ofrecidos. Estas modificaciones tendrán asimismo validez en caso de que, por cualquier causa, se viera afectada la posibilidad de suministro de los servicios ofrecidos.

ENTRADAS Y SALIDAS

Las entradas y salidas de los alojamientos serán en el día estipulado en la reserva.

Entradas:

El horario de recogida de llaves es de 14:00 a 20:00 en el propio alojamiento reservado.

• Antes de las 14:00 el alojamiento no estará
• Si se llega antes, puede que el inmueble no esté disponible, con lo que deberá contactar NESTANZA para buscar intentar alcanzar una solución.
• Para llegadas a partir de las 20:00 y hasta las 22:00, habrá un coste adicional de 30,00 €.
• Para llegadas a partir de las 22:00 y hasta las 23:00, habrá un coste adicional de 50,00 €.
• No se aceptan llegadas más tarde de las 23:00; estas se dejarán para las 9:00 de la mañana del día siguiente.

A la llegada al inmueble y conforme a la legislación vigente, el USUARIO deberá entregar la hoja de reserva en papel o formato digital, y se procederá a identificar a todos los ocupantes del alojamiento. Como se informaba anteriormente deberá abonar el segundo mes de fianza y mes en curso mediante transferencia bancaria, tarjeta de crédito o efectivo.

El alojamiento se entrega limpio y con todos los utensilios y menaje de cocina. Las toallas de baño y las sábanas por persona están incluidas en el precio del alquiler.

Salidas: El horario de salida de los alojamientos es hasta las 12:00 PM, depositando las llaves dentro del alojamiento. Posteriormente una persona de la agencia se presentará en el alojamiento para comprobar el estado del inmueble, recoger las llaves y se devolverá su fianza en el plazo estipulado en el apartado “Fianzas” del punto 2.

SERVICIOS EXTRA

Si el USUARIO está interesado en contratar un servicio extra, debe hacerlo en el momento de hacer la reserva:

La limpieza diaria del inmueble es responsabilidad del/ los inquilinos. La limpieza semanal del inmueble por parte del NESTANZA está incluida en el precio pactado, si bien NESTANZA no se responsabiliza de los daños o deterioros causados por la falta de limpieza diaria o mal uso de las instalaciones.

Cama Extra: El alquiler de cama extra es de 100.00 € siempre que exista disponibilidad, el inmueble lo permita y tenga de apartamento.

Los precios que se indican respecto de cada reserva incluyen cualquier Impuesto. Estos precios, a menos que se indique expresamente lo contrario, no incluyen las tasas turísticas, el seguro de viaje, los gastos de envío, o cualesquiera otros servicios adicionales y anexos al servicio adquirido.

Los precios aplicables a cada inmueble son los publicados en el sitio web y se expresarán en la moneda EURO. El USUARIO asume que la valoración económica de algunos de los servicios podrá variar en tiempo real. Los precios pueden cambiar diariamente mientras no se realice la reserva.

FORMAS DE PAGO, CARGOS Y DESCUENTOS

NESTANZA es el responsable de las transacciones económicas y posibilita las siguientes formas para efectuar el pago de un pedido: Tarjeta de crédito, bizum, transferencia bancaria.

TARJETA DE CRÉDITO

Las tarjetas de crédito aceptadas por nuestro TPV Virtual son Visa, Mastercard, American Express.

En MATCH4ROOM nos importa la confidencialidad de tus datos, por lo que nuestro TPV Virtual ofrece los máximos elementos de seguridad para proteger al comercio ante posibles pagos fraudulentos ya que integra CES (Compra Electrónica Segura) que, bajo los protocolos internacionales Verified by Visa y MasterCard SecureCode (ambos basados en la tecnología 3DSecure), aporta una alta seguridad y protección en los pagos.

Mediante la aplicación de estos protocolos se consigue la autenticación del titular al realizar la compra, es decir, que el cliente se identifique como legítimo titular de la tarjeta que está utilizando.

Nuestro TPV Virtual te solicitará de forma obligatoria la introducción del CVV2 de la tarjeta (serie de tres números situados en la parte posterior de la tarjeta) como una medida antifraude, además de aquellas exigencias adicionales que solicite tu banco de origen.

Web security measures

NESTANZA se compromete a no permitir ninguna transacción que sea o sea considerada ilegal por las marcas de tarjetas de crédito o el banco adquiriente, que pueda o tenga el potencial de dañar la buena voluntad de los mismos o influir de manera negativa en ellos.

PROCESO DE COMPRA

La página web tiene un sistema de búsqueda por diferentes parámetros para facilitar la elección del alojamiento. Tipos de reservas:

Una vez guardada la cesta se procederá a calcular los impuestos, cargos y descuentos según los datos introducidos.

Las cestas no tienen ninguna vinculación administrativa, solo es un apartado donde se puede simular un presupuesto sin ningún compromiso por ambas partes.

Desde la cesta se puede hacer un pedido siguiendo los pasos siguientes para su correcta formalización:

DISSOCIATION AND SUSPENSION OR RESCISION OF THE CONTRACT

If any of these terms and conditions is deemed unlawful, void or for any unenforceable reason, this condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.

NESTANZA may, without prior notice, suspend or terminate the USER’s access to its services, in whole or in part, for any valid reason, including, without limitation, when the USER does not comply with or follow any of the obligations set forth herein or any applicable legal provision, license, regulation, directive, code of practice or use policies.

Where NESTANZA exercises any of its rights or powers under this Clause, such exercise shall not prejudice or affect the exercise of any other right, power or remedy that may be available to NESTANZA.

WARRANTIES AND RETURNS

The guarantee of the services offered will respond to the following articles based on Royal Legislative Decree 1/2007, of 16 November, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.

RESPONSIBILITY FOR NESTANZA

NESTANZA will be liable to the USER for any lack of conformity that exists at the time of delivery of the accommodation.

REPLACEMENT OF THE HOUSING SERVICE

Any form of sanitation that imposes costs on NESTANZA that, compared to the other form of sanitation, are not reasonable, taking into account the value of the service if there were no lack of conformity, the relevance of the lack of conformity and whether the alternative form of sanitation could be carried out without major inconvenience for the USER.

The replacement shall be in accordance with the following rules:

5. APPLICABLE LAW AND JURISDICTION

These conditions shall be governed by or construed in accordance with Spanish law in what is not expressly established. NESTANZA and the USER agree to submit to the courts and tribunals of the USER’s domicile any dispute that may arise from the provision of the products or services subject to these Conditions.

In the event that the USER has his domicile outside of Spain, NESTANZA and the USER expressly waive any other forum, submitting to the Dispute Resolution Body that will act as an intermediary between the two in accordance with Art. 14.1 of Regulation (EU) 524/2013, without the need for the courts of justice.
